These Terms of Service govern your use of Giftory and any related websites, applications, features, and services operated by us.

By accessing or using Giftory, you agree to be bound by these Terms. If you do not agree, you should not use the platform.

2. Our Service

Giftory is a platform that enables customers to discover, purchase, and receive products and services offered by participating stores and merchants. Some services may involve third-party logistics, payment processors, or other partners.

3. Eligibility and Account Responsibility

You are responsible for providing accurate account information and for maintaining the confidentiality of your account credentials. You are also responsible for activities that occur under your account unless caused by our fault.

4. Orders and Availability

All orders are subject to availability, acceptance, pricing validation, payment confirmation, and operational feasibility. Giftory or the relevant store may cancel or decline an order in cases such as pricing errors, inventory issues, suspected fraud, compliance concerns, or delivery limitations.

5. Pricing and Payments

Prices, fees, taxes, delivery charges, and promotions may change from time to time. By placing an order, you authorize the applicable payment transaction using the payment method you select.

Giftory may use third-party payment providers to process payments. Additional terms from those providers may apply.

6. Delivery and Fulfillment

Delivery times are estimates unless explicitly confirmed otherwise. Delays may occur due to operational, merchant, customer, weather, or logistics issues. You are responsible for providing complete and accurate delivery information.

7. Returns, Refunds, and Cancellations

Returns, refunds, replacements, and cancellations are subject to the nature of the product, the participating store, applicable law, and Giftory's published refund rules. Personalized, perishable, or time-sensitive items may not be eligible for cancellation or return once processing has started.

8. Acceptable Use

You agree not to:

  • misuse the platform or interfere with its operation;
  • provide false, misleading, or fraudulent information;
  • violate any law or third-party right;
  • attempt unauthorized access to systems, accounts, or data;
  • use the platform to harass, abuse, or harm others.

9. Intellectual Property

The platform, branding, content, interfaces, and related materials are owned by Giftory or its licensors unless otherwise stated. You may not copy, modify, distribute, or exploit platform content except as allowed by law or with written permission.

10. Third-Party Products and Services

Products and services listed on the platform may be offered by independent stores or merchants. Giftory may facilitate the transaction, but the merchant remains responsible for the product information, preparation, and merchant-side fulfillment obligations to the extent applicable.

11. Suspension and Termination

We may suspend, restrict, or terminate access to the platform if we reasonably believe you violated these Terms, created risk or harm, or if required for legal, security, or operational reasons.

12. Disclaimer

The platform is provided on an "as available" and "as is" basis to the maximum extent permitted by law. We do not guarantee uninterrupted availability, error-free performance, or that every listing, delivery estimate, or third-party service will always be available.

13. Limitation of Liability

To the extent permitted by applicable law, Giftory will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from use of the platform.

14. Indemnity

You agree to indemnify and hold harmless Giftory and its affiliates, officers, employees, and service providers from claims, losses, liabilities, and expenses arising out of your misuse of the platform, violation of these Terms, or infringement of any rights.

15. Changes to the Service or Terms

We may modify the platform or these Terms at any time. Updated Terms become effective when posted unless a later date is stated.

16. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which Giftory operates, unless mandatory law requires otherwise.
